What will happen to assigned land (laoni patta) after

Dear Sirs,

My Grand Father was being assigned piece of land by Govt. in 1956, Currently this part in in Telangana state, He was in possession of the land and was doing agriculture till his death in 1996, post which my father and his elder brother carried on agriculture on the same land they both had applied for Patta Passbooks and MRO has issued the same on both of their names. Now both (Father and his elder brother) are expired in 2015 & 2017 and also both Mom and Big Mom also expired. Now, there are 9 children (5 boys and 3 Girls) as Legal Heirs,
1. Can we take possession of this property?
2. what will be the status of land after assignee expires? will it be still considered as Laoni Patta, as the assignee is expired and so as next generation? will it become a Patta Land after two generations?
3. Can the grand children apply for mutation of the land and Sell the land?

Yes, the property is already vested with you and you can get the mutation carried out, preferably on the basis of a partition or settlement deed.

Also, the main doubt remains, what will happen to the assigned land after assignee is dead? Will Govt take it back? What will be the nature of the land as Assignee is no more, who then will be considered as Assignee?

To answer your questions it will be necessary to see the deed of assignment given to your father.

Respected Seniors, As advised, we have applied for Mutation to the concerned MRO officer, but they are not executing the mutation, now, what options do we(All the legal heirs) have? and How to proceed.

Have you submitted all relevant documents with the MRO office? If so please pursue the matter with the MRO. If they do not reply properly file complaint with the Collector.

The said property shall equally be assigned in two parts-one half for the legal heirs of your father and rest one half to the legal heirs of your uncle and on the basis of this share, either of you can get the partition proceedings completed before local Assistant Collector 1st Grade.

Thanks a lot Raj Kumar Sir, however we have filed for mutation with concerned MRO office but they are delaying saying this is a assigned land, my basic doubt is will this land called assigned land after the primary assignee(My Grandfather) is expired and his sons also expired, now we are 3rd generation? Can we called the Pattadars of the land?

The MRO has issued Patta pass book. As such, it is ordinary ryotwari land, unless the patta imposes any special/onerous conditions; the land is fully heritable. At present is property is vested with the legal heirs of the pattadars.

In my understanding, they are can execute a partition/settlement deed and it would be a better option to pursue the mutation on the basis of the such deed, duly executed.

May approach higher authority if Mutation not entered by MRO.
