Sir for dept.enquiry .you may appear in person or take help of local advocates.you have to reply chargesheet filed against you denying all allegations and submiting relevent supporting documents. It is a dispute between employer and employee..be careful and submit detailed reply to the chargesheet allegations. Enquory officer will be appointed and you should attend the enquiry dates will cool and confident replies.they will record daily report of said enquiry.If enquiry officer is satisfied with your explaination then enquiry will be closed and report will be sent to officer concerned and dispute can be resolved.but if adverse report then as per terms of employment and seriousness of allegations action will be taken by employer. The said order of employer can be challenged before appropriate court depending up on jurisfiction of courts .You have not mentioned the details of employer because if govt employee central govt admn.tribunal and if state govt employee state afmn.tribunal has jurisdiction and if pvt industrial employee then Labour and Industrial courts have jurisdiction for dispute regarding employment of employee..advisible to kindly try to resolve dispute amicably considering the interest of your family .good luck

In a departmental inquiry, as a rule, the charged officer cannot take assistance from a legal professional. He can defend himself or defence assistance, a serving or retired government employee. In exceptional cases, a legal professional could be the defence assistant, if the Disciplinary Authority permits. In you case has the has DA granted permission to engage a legal professional?

You are disclosing that you want to defend deptt inquiry.
(atleast what is understood).
You have been clearly advised that in deptt inquiry you cannot take the services of lawyer unless permitted by deptt. It is a concession not a right.
Further you have got a RIGHT (not concession) to name a serving/retd govt servant (OF YOUR CHOICE) to defend you in the inquiry who is willing to help you.

No permission of the Disciplinary Authority is required in engaging a serving or retired Government employee as Defence Assistant (of course, it is another matter that such defence assistant, if a serving employee, requires the permission of his controlling officer/HoD to remain absent from his duties during the period of inquiry). It is only when the charged officer wishes to engage a legal professional that permission of the Disciplinary Authority is necessary.

There is no question of DA permitting services of Def Asstt. It is a statutory right.

Well Advised by Experts and though only your self has to represent you could seek the guidance of an good Advocate how to represent and what to be stated.. Local Advocate is not mandatory in such matters and you could seek the guidance of Advocate Mr.P. Venu who is a Retired Government Officer also who would have dealt such similar things of yours in his vast experience..
