They told us that they will hand over the site within three years but till date no development has been made even they are not showing us the legal property papers about their progress. Kindly help me will I get the site or the amount paid with an interest. Please let me know the procedure of how to process ahead

If you suspect a foul play or you do not have confidence anymore on the company/builder or there is no possibility for the completion of construction in the reasonable time in future, you may decide to cancel the booking.
You may communicate your decision to cancel the booking in writing and send the communication by registered post and mention the reason for cancellation is due to inordinate delay and no clear picture about the completion of construction etc.
You may demand the return of booking amount with interest.
Upon failure to respond or comply with the demand made, you may approach the consumer forum with a complaint for return of the booking amount with interest and also for compensation for the deficiency in service.
You may discuss with your advocate and proceed on the advise/suggestions received.

Issue legal notice in this regard to builder/developer and if notice not complied with then file complaint before District Consumer Forum.
