This query is : Resolved
A partnership deed was entered before 20 years back in between 3 partners. Now the firm has to open the demat account in the CDSL, but the cdsl requires either registered deed or notarised deed of partnership.
Sir my query is that can these partners again enter into the partnership deed , and get it notarised, taking support of the earlier deed which was not notarised.

You can get the partnership deed drafted, executed and get it registered.

It is better to execute a fresh partnership deed and get it registered before the Registrar of Firms concerned than notarised.

You have the options :
1. To prepare a fresh partnership deed;
2. To get the attestation of a notary public on the existing partnership deed.
3. You can reconstitute the partnership deed using the opportunity.
The partnership is an agreement between two or more persons for sharing the profits of a business carried on by all or any one of them acting for all.
Any change in the existing agreement is known as reconstitution of the partnership firm.
Generally, reconstitution deed is executed between the continuing partner's on the strength of a retirement agreement signed by all the partners,ie., including retired and continuing partner's.
