Cancellation of settlement deed

Querist : Anonymous (Querist) 22 July 2020 This query is : Resolved
Hello Experts,

My Grandfather had 2 daughters. He had 2 acres of land along with a house built there. Latter he made settlement deed to one grand daughter.

After some years, that grand daughter sold 1 acre. Then they started ill treating my Grandfather. He approached DRO and appealed him. After investigation, Under Senior Citizen act, RDO cancelled the 1 Acre and posted the orders.

Now Sub Register and Revenue officials are npt supporting him to change the 1 Acre land to him.

What are the next steps. Please guide me.

Your grand father need to apply under the provisions of Maintenance and Welfare of Parents and Senior Citizens Act before the Tribunal. You can go through Judgment SHRI. NEELKANTH S/O PANDHURANG ROHIKAR V/S SHRI MANOJ S/O NEELKANTH ROHIKAR AND OTHERS, Writ Petition No. 828/2019 decided on 03/05/2019 by High Court of Judicature at Bombay, Nagpur Bench.

Senior citizen should request the district officers (Deputy commissioner)/ DRO/ RDO, to direct the concerned N Tehsildar to carry out orders of senior.

Contact local lawyer to find out whether RDO was right to cancel the said settlement deed.

Your grand father can approach DRO again.

He is your grandpa, you too can save him. You want the other grand daughter to help him.

Why?

Why is that the Sub-registrar not acting upon the orders of the DRO? Please ascertain the reasons, if need be, under the RTI Act. How qre the Revenue Officers involved in the alleged indifference?

One reason of non action on the orders from RDO may not have such power.
