I have entered a lease agreement with BSNL with effect from 2005 to construct and operate a mobile tower in my property.The period of the agreement expired on march2020.Nothing was done by BSNL till August 2020 either to renewal or to vacate.I have sent a regd.notice to them stating that the period of lease expired so your immediate intervention in this matter is urgent otherwise after the expiration of 30 days of this notice your entry to my property and operate of Tower will be treated as illegal..Is that notice is legally valid?

You have to issue notice u/sec 106 of T.P.Act to lessee ( BSNL ) mentioning therein that lease period of Premises have already been expired on March 2020 and ask to vacate the premises within 30 days from receipt of notice.If BSNL does not vacate the premises within said 30 days then file eviction suit against them.

If no action on legal notice, file eviction petition.

Yes. You can file an eviction petition. But usually, in Government organizations, a confirmation letter from higher authorities has to be received to them. Until then they keep quiet. But if they do not come for continuous agreement or to vacate, ask them the reasons for the delay in making an agreement through RTI. Mark a copy to the GM of the region.

You have the only option to engage a local prudent lawyer for issuance of legal notice followed by filing a suit for eviction, recovery of outstanding dues, damages, mesne profits, permanent and mandatory injunction.
