Querist : Anonymous (Querist) 02 January 2021 This query is : Resolved
My brother took signature in Mamlatdar as i write all property come from my dad will go to his name in future after my dad passed away and now he removed name of 7 / 12 utara but out of 5 sister 2 did not give signature. Can i file objection for this as he forced me to write my rights on his name ?
father añd mother both passed away. We are 6 sisters and 2 brothers. Part of property is self acquired and rest is not.

Your query is not clear. Whether the property is ancestral or self-acquired by your father? Is he alive? What about your mother? How many siblings you have?
Advocate Bhartesh goyal (Expert) 03 January 2021
You may raise objection but you have to prove by cogent evidence that your signature has been obtained by force or pressure.
Sudhir Kumar, Advocate (Expert) 03 January 2021
a concrete view can be formed only after seeing the papers.

However, you have to be prepared for total loss of relationship (irrevocable and irrespective of quantum of property), if intending to raise property dispute in court.

Loss of relations has been done sir.

All documents need to be referred before forming an opinion, consult local lawyer.

The facts posted lack clarity. Anyhow, mere changes carried out in the 7/12 (Record of rights) would not lead to creation or relinquishment of title to property.

Vague facts can not lead to form an opinion and oblige.
It is better to consult and engage a local prudent lawyer for appreciation of facts/ documents, professional advise and necessary proceeding.
