Conveyance matter

chiefpromotercum secretary on behalf of society having irrev.powerofattorney from landowner is refusing conveyance. currently new office bearers elected. what are steps and legal provisions requirements for new office bearers to get conveyance done since 6 years back earlier chiefpromotercum secrtary declared that he will convey within 6months of society formation.

The developer/seller of property after sale agreement is obligated to complete the sale by way of execution and registration of a proper deed of conveyance. If they default in doing so then you can file case before the consumer forum for getting such relief and for damages also out of the delay occurred out of this.

Another remedy is to file an application under Sec11 0f the MCS Act for deemed conveyance. Advantage in following this procedure is that the matter is disposed of within 6 months of filing the application and in case the Chief Promoter/Owner does not cooperate the Registrar himself will sign the sale deed and such sale deed is registered by the sub registrar without much hassles. This procedure is available only in Maharashtra.
