Correction in birth certificate

(Querist) 12 January 2013 This query is : Resolved
My Name is Valerian Vincent D'Souza and I am a resident of Mumbai, My father's Name is Peter Fermino D'Souza and my Grandfather's name was Diego Francis D'Souza. The Bombay Municipal Corporation has stated my father's name as Peter Diego D'Souza in my birth certificate, while in the birth certificate of my 4 younger brother's it is mentioned correctly as Peter Fermino D'Souza. I have asked the BMC to make a correction and now they have asked for documents after my parent's marriage and before my birth which we dont have. Even my parents marriage certificate where the names are correct is not being accepted. In goan Christians the second name is not the father's name unlike hindu names. After six months of following up and the case being even sent to central bmc office at Palton road, the BMC is now telling me to make a court order. My father is still alive. Is there a easier way of correcting my parents name in my birth certificate. Thanks. Valerian.

if bmc has intimated you in writing to obtain a court order for correcting father name in your birth certifcate then do so .

Thankyou for such a quick response. BMC person has only mentioned verbally that there is a remark from their department. Nothing has been given in writing.

You can inform the BMC that you would comply with their requirement and that in order to do that, you need a written endorsement from them..

I have got details from the BMC in charge of departments of births and deaths that I have to apply in metropolitan court no. 10 at Andheri court, Mumbai. It is supposed to be a simple matter with an affidavit to be filed and one hearing with the BMC official with the persons whose names need to be corrected. If anyone can suggest a good lawyer who can handle such case in the Andheri vicinity I would very much appreciate.

I have finally got the birth certificate changed. It took one year of waiting. Lawyers fees were upto 40000 so I approached an NGO who helped in drafting RTIs. Thanks for all your help
