Court fees for probate

(Querist) 17 October 2011 This query is : Resolved 
once probate decree had passed by courtin favour of beneficiary of registered WILL,then
1)Is it necessary again to pay stampduty & registration fee in sub register office inorder to enter his name as owner in BOOK no 1 for said property
2)Is there any exemtion for no need to pay stampduty & registration fee for particular said land after the probate decree had passed by court to beneficiary
3) what is the court fee to be paid for probate of registered WILL in which property land cost is Rs 30 lakh(Andhra pradesh)

As far as State of West Bengal is concerned there is no requirement for paying separate stamp duty once the Probate is granted by the court.

1. Stamp duty is payable only in the court and no fresh registration is required and direct mutation can be got entered by beneficiaries.

court fees is always a state subject and it does differ.

The probate is given.
There is no need for registration, in fact it cant be registered in registrar office, because the property has already passed.
If the disputed sale is confirmed by the court, it has to be registered.
Here, what you have to do is mutation of names in public records.
