(Querist) 06 June 2016 This query is : Resolved
Sir,

Court order taken from e courts services portal, basis on court order copy shall we can file appeal in court of law, as in court order copy no signature is available.

Please inform as i had given compliant against my neighbour in GHMC for illegal construction of building and case was running between my neighbour & Greater Hyderabad municipal corporation.

Now case was dismissed by court for DEFAULT

Thanks

Without getting certified copy from the court appeal can not be preferred.
Copy from e-court portal is not a certified copy.

Copy of order from e-court portal is only for referring purpose. It does not suffice to file an appeal. As our learned expert said you need to file a certified copy.

Well advised. Agree with the experts.

You dont have to prefer an appeal for dismiss for default. You can file a restoration petition to restore the same in the same court. For this you dont require a copy of the judgment.
Ask your advocate more on this.

I fully agree with the expert advise of Mr. T Kalaiselvan, Advocate, and appreciate his opinion qua a suit/petition dismissed in default is "non-appeal-able" which is to be restored by the same Court where it was pending, discuss with your lawyer.
