Coverage under id act 1947

Respected Sir,

My query is whether private hospitals particularly corporate hospitals or hospitals under management of body corporates is an Industry. It is the same service sector like restaurants and Hotels which are not covered by Factories Act, 1948. Hence is there any law in our country which provides for protection to people in service organisations in private sector.Does the ID Act covers above workmen if he or she is retrenched or dismissed from service.

Definition of the word "industy" as contained in Section 2(j) of ID Act, 1947 is very wide to cover any business, trade, undertaking, manufacture, calling, service, employment etc. Hospitals are service providers and also "calling" (i.e., profession of Doctors); hence are industry within the meaning of the above definition. Workers of hospitals whether run by individuals or companies or corporate are industries for the purposes of the Act. Persons working in subordinate categories in hospitals would be workmen for the purposes of the Act.
