My uncle expired in 2009 having one and only daughter as legal heir. Now one of his brother came forward and showing an unregistered sale of agreement document written as on 1992 on Rs.20/- stamp paper. That too written by one person and witnessed by the writer's son. Even my uncle's signature was forged. Is it possible to book a criminal case on my uncle for doing forgery if so please let me know the validity of this stamp paper and does it holds good in any situation. I thoroughly enquired and came to know that it was written after the demise of my uncle. Please help me

What is written in the agreement?
The agreement is about?
Presuming that the agreement is about sale of ur uncle's property, if your uncle was in possession of the property, forget about the forged agreement.

An agrement for sale signed by only one of the parties is an incomplete document and not enforceable under law. Further the document stamped with Rs. 20/- is understamped and hence not admissible in a court of law. If u are in Maharashtrra, AFS is to be registered compulsorily. In view of all the above you should ignore the document and ensure that ur cousin's rights are secured legally. If u are sure that the document is a forged u can file FIR with the police.
