Criminal trial an accused is discharged revision - condonation of delay dismissed

(Querist) 25 April 2013 This query is : Resolved
Sir,
In a property matter it is alleged that an agent impersonated a deceased person and forged his signature to obtain Land Conversion Sanad before the Deputy collector for a person who carried out illegal construction in a property that is fraudulently Partitioned. The Deputy Collector upon information filed a Police complaint against the person who was seeking the LCSanad. After investigation the case was referred to the Judicial Magistrate First Class. The Public Prosecutor having conflict of interest did not place all evidence before the JMFC and as a result the said person got discharged. Upon information we requested for revision. The Directorate of Prosecution passed order to file revision. The Public Prosecutor filed a faulty Application for Condonation of Delay as a result the Condonation delay was dismissed for being faulty and without an affidavit. The case now is at a standstill. The person who persued the LRC is free and has produced the order of dismissal in the Civil Suit. Is there any remedy to start a trial and complete the case?

You can challenge the order of dismissal of delay petition in the higher court.
The de facto complainant can challenge such order now . Even earlier in stead of requesting prosecution, the complainant should have moved to higher court.

If anyone has grouse against any order, he can very well get the same challenged before upper court within the provisions unless justice is made thereto.
