Cross examination

(Querist) 15 April 2012 This query is : Resolved 
U/s 138 of NI act the director who represents the accused company was cross examined by the complainant. But the cross examination was recorded in a single form as if the director alone committed offense. When one of the director is representing the accused company, in my opinion his cross examination is not to be recored in single person. but due to this mistake, his evidence itself may got against him. Therefore my question is that, whether a cross examination is to be recorded in a single form.If so whether it is relates back to the evidence of the company itself. what remedy is available to him. Is it corrected by re examining the witness ?

Cross can make or break a case and particularly cheque cases.

However your question can be better explained if the original deposition is seen.

Right ! looking into disposition is the need
to reply with certainty.However the deposition is binding upon the company.
