Sir Whether the abuses and other conversation made in public by the complainant , which were recorded with the help of a tape recorder by the opposite party , can be played during the cross examination of the complainant in a criminal trial before the court? What is the procedure of it and whether it is of any evidentiary value in view of the fact that complainant has alleged in his complaint that opposite party used to abuse him and his family? matter is relating to 323 IPC. Pl advice

Yes you can file the recorded evidence with the permission of the court.
It can be played to prove your case. In case the party disputes his voice, you can send it for forensic lab.

There is a long procedure for this purpose. First of all recorded is to be verified as authentic by getting it verified from forensic lab with the permission of concerned court and thereafter this recording can be put before concerned witness with further permission of court which can very well be rebutted.
