Cross examination

(Querist) 22 November 2012 This query is : Resolved 
Dear Sirs,

Can I submit the list of questions before I start cross examination to the Hon'ble Judge / Court, that I have prepared for cross examination for divorce case. If yes, should I submit the questions on the day of cross examination or submit the list of questions vide a memo and continue cross examination.

You are not bound by any law to produce the list of your questions rather you are free to ask any question related with the matter. For your own convenience, you may write down the questions so that you may ask those all as per your convenience.

Yes. There is no requirement of law or practice to submit to the judge the list of questions a party proposes to ask in the cross exam or exam of a witness.

Why should the parties submit a list of questions for Cross-Examination beforehand?

Civil Procedure Code do not require submission of list of such questions and if there is some local tradition to do so, none can force them it to continue as law do have any provision thereto.
