Crpc 125

Hello Sir

I am fighting my Crpc 125 case in person.

Due to unavoidable circumstances, I won't be able to attend next date of court proceedings i.e. on April 4th.

Please clarify me on

1) Can I move any application in the Hon'ble court to change the hearing date. If yes, on what grounds

2) If I don't go with moving any application, then how can I inform Hon'ble court that I will be unable to attend the court.

3) Is there any action, if I don't inform the court and just don't appear on the said date.

Please suggest.

1. no, YOU CAN PRAY FOR ADJOURNMENT BUT THAT IS TO BE FILED ON 4TH April ONLY.
2.Engage an advocate or send someone you know.
3.The court may pass adverse order.

You can prey the court through another Advocate or some person through application (to appear personally) for next date. Court may pass adverse orders in case of your absence.

personal persence is mandatory ifyou are fighting the case yourself.
it will be better to engagea lawyer.

This is the main draw back when the case is pursued as 'party in person'. Without a vakalat an advocate cannot enter appearance, it is advisable for all the practical problems, to engage a lawyer as soon as possible.
