Very odd question without making clear the background why you could not get custody of your child?
Has the Vietnamese gal or your husband made your son as their captive or your son does not want to return to you?

What is your religion?
Whether they have married?
You can file case for custody and meanwhile prey for interim orders for visitation rights.

Sorry for half info.
I am Muslim woman , age 45. thay haven't made my son their captive, my son wants to be with me.i want temporary separation from him till he doesn't get finish his affair with tht gal. My husband hasn't got married wit tht woman yet. We r Indian and our full family is here . She is Vietnamese

Your query seems to be absolutely hypothetical and of academic nature.
If there is even a slight truth in your story, please clarify on the following points:
1) What about you, if they have made captive your son?
2) What for they have made your son captive?
3) Why not you were also made captive?
4) Also how could you get rid of them and where staying presently?
5) Why no step was taken by you for the last 5 years?

You can file a suit for custody of child.
However you can not apply for temporary separation from your husband.
Either you allow status quo or file suit for dissolution of marriage.

Dear experts , I stay in Pune with joint family. My husband visit Vietnam for business since 5 years . The gal who takes care of office in Vietnam is my husband's partner in business . I can't c my husband 24 hours with her on chat . he has told tht gal tht I hav no relation wit my wife, she is only for world I sleep separate in my room and she wit child in other room, and this is true as we 3 can't fit in one bed and we hav big house so I used to sleep in other room which next to my husband room , he is blindly in love with tht gal and he does wht she tells him.
before 5 years I couldn't take n e action as my son was small and joint family I hav so didn't know where to go and wht to do ? Whom to contact,
My husband brain is very powerful . I want my son custody and he knows I bare this affair just bcoz of my son. I don't want my son to suffer as he doesn't take care of his own paralytic mom and unmarried sister.. my sis in law takes Care of my mother in law and if I leave the house ther is no one to take care of my son
Plz plz advice me where should I go and if I case and file against him , is there n e chance of winning the case ?
And how much amount I will b needing in this full process ?
