This query is : Resolved
Sir, I listed my phone in Olx to sell it. However, the buyer who has approached me via Olx was an international buyer. He was offering me a good price, so I sold my phone. I shipped the phone via courier to Dubai after he sent me the payment confirmation email. But it was after a day I came to know that it is a fake email. I want to file a FIR against the person. But my question is while I sent the phone via courier I didn\'t know him and I sent it as a normal user, not a seller. and I mentioned that I am sending it only for consumption purpose, not for money. Will it be a big problem for me if I go to the police?

Email confirmation of payment is not sufficient, you should have confirmed about the payment before dispatching the product.
FIR against the cheat won't serve your purpose if he's untraceable.
You lost your phone and got no money, it's a total loss.
As far declaration in courier is concerned that was made for transaction purpose to save custom duty for which Custom department will question and it's not under the jurisdiction of police who have to check crime and criminal.

Vague query. Most probably your query is an academic query only. Mind you, Dubai is neither a poor country, nor international buyers can be expected to buy used up second hand mobile phone sets.
Question arises, how you could land on the international site of the OLX when in India, it opens for the Indians to make transactions in India. Even if you try to write "www.olx.com", the Indian site of OLX, i.e., "www.olx.in" is opened, which being very widely used in India. It is not understood, why you felt need to sell your mobile only on the international site of OLX? That clearly reveals that your query is hypothetical only.
Even if your story is true to some extent, your query is quite premature to seek any solution to any event that has not happened as yet. For the present, you don't have any legal problem, except loss of money.
On your query, even if you are informed that there will definitely be a very big problem for you, what will you do, when you would not be able to anticipate the nature of problem to be created by any future act of the buyer?
As regards FIR, nobody can bar you to lodge an FIR. You can feel free to do that.

Mr. Ravi,
Observation of Mr. Jigyasu is very correct, as you have a track record of posting only academic type of problems, not real personal problems.
Anyway, lodging FIR is your prerogative, you can do that. But, nobody can perceive what serious problems you can expect to be faced in future, if your version is correct. Recovery of money is a secondary issue but with very negligible chances, particularly when the buyer is a foreign national.
