Dasti notice

i requested for stay and transfer of case to delhi from SC.I got stay order from SC stating, "issue notice, returnable in ten weeks, dasti permitted". what does this means? what if the other party(respondent) did not sign the acknowledgement of dasti notice or he went untraceable. what will be the process in either of the case. will transfer of my case delayed because of this?

"Dasti" means by hand. The delivery of the Court's Notice on the other party is to be made by the Petitioner or his/her counsel. However, it is not necessary that the petitioner should personally serve the Notice - it may be served through speed post/registered post (with AD) and an affidavit to this effect may be filed on the next hearing.

but what if other party does not accept the notice or becomes untraceable... how long this process will go of delivering the notice to the other party

Obviously, the respondent is the original petitioner/complainant and the Notice has been sent to the address as furnished by that party. The affidavit of the Notice sent to that address is just and sufficient. If there is any mischief in accepting the Notice,this cannot but be willful; this could also may be highlighted in the affidavit.
