Hello Sir,
I am writing on behalf of my Sister. My brother-in-law died 6 months back and my sister does not have any source of income except for few lakhs she received from Insurance company. Can my sister claim share in the self-owned property of her father-in-law in the event of her husband's death. She has two son's, and one son is mentally and physically disabled. Her father-in-law is not ready to give any financial support to my sister. Kindly provide your guidance on the situation

Wife has no share in father in law's property if the same is the self acquired one.

I fully agree with the experts advise of Mr. Devajyoti Barman. Being widow DIL your sister cannot have share of property from her FIL's self acquired property. However, on the death of her FIL she (as well as both of her sons) shall have equal share, if the property will remain intestate.

No share during life time of her father-in-law.

Self acquired property can be disposed by owner as per his wish by gift, sale, or will. A DIL has no right in it during lifetime of FIL self acquired property.
If FIL expires without a will, she has a claim.

a hindu widow has right of maintenance and right to ask for place to live after husband death. but she cannot claim share of the self acquired property of father in law. after FIL death ,she and her children can claim share in FIL property if he dies intestate.

I fully agree with the views expressed by expert Mr. R.V.Rao garu. The widow has a right to residence in her father in law's house however cannot claim a share in her father in law's self acquired property.
