Daughter's share in the property of mother

Online (Querist) 21 October 2024 This query is : Resolved
My cousin's has two sisters and one brother. His father bought 200 sq. yards residential land in my cousin's mother's name in the year 1995 and since then the property is lying only in the name of my cousin's mother.

Recently my cousin's mother passed away.

Now, the query is : "Whether my cousin's father alone will become leagal hier of my cousin's mother's property or all the family member of my cousin i.e. my cousin's father, two sisters and one brother". If so, what would be the share of each member of the family?

Awaiting your valuable reply in this regard.

Thanking you

Your cousin's father, your cousin and her siblings have equal rights over your cousin's mother's property.
T. Kalaiselvan, Advocate (Expert) 21 October 2024
If your cousin's mother is reported to have died intestate then the properties left behind by her shall be succeed by her legal heirs/successors in interest as per the personal law to which your cousin belongs to. His father alone can acquire the property only if the mother had left any will on his name
Advocate Bhartesh goyal (Expert) 21 October 2024
Your cousin's mother's property rights will devolve to her legal heirs I.e her husband and children ( sons & daughters) equally.
Dr. J C Vashista (Expert) 23 October 2024
The property left behind by deceased shall devolve upon all her legal representatives as per her personal law .
