Daughters rights in the property of parents

(Querist) 29 March 2013 This query is : Resolved
I am happily married from 18 years. I have a brother & sister. In Pvt. Ltd. Co. of my family business from my parents side in which my father, mother, sister, sister-in-law, brother, myself & my husband are directors. Due to conflicts with my brother I have started my own business from last 3 years. I & my husband are still directors in that Co. My father & mother have earned all the properties & assets with their own efforts. Now, my mother and father are supporting my brother & boycotted me & my sister. Now I just want to know if we both can claim any share in the property of our parents. I will be very much thankful with needful guidance please. Thanks.

You have not mentioned about your religion. If you are governed by Hindu law, if it is self acquired property of your parents, you have no right. If the properties are of ancestral nature then you can claim property. Apart from that as per company laws, as you and your husband are still its directors, you both are entitled to your shares. As this is complicated case, you have to hire a good lawyer.

You or your sister can not claim right in any self earned property of your parents during their life time for they are absolute owners, free to sale or gift or will to any body of their choice.

Your or your sister's right can emerge only if they die intestate.

The co. properties are belonging of the co. itself in which you can claim liquidated sum of your share holding,if you hold any.
