Declaration act came in indira gandhi's rule

Hello All,
under Declaration Act came in Indira Gandhi's rule. we got 1 acre land and the land documents (RTC) shows my father name but the problem is we did our document in district's office 2 years before ,but original owner of land as told us that he put stay for transfer of land 3 yrs before so your document is not valid.

we have home in that land and we pay tax to govt from 1975.

1. my qus is how district's office dont knw about stay on our land or the owner of landing is simply lieing???

2. is it possible to transfer land when there is stay on that land

3.

If there is no irregularity in your papers then file a suit for declaration and injunction which however may take some time for final conclusion.

If there is a stay on the land then you can not legally transfer the same.

1]ask the land lord to show order of court??
might be he he is ditching you.

2]In case stay is there you can not sale.In that case you should apply for impleadment as
party in the case and then should move application for vacating the stay.

the document transferred to my father name legally and it is showing in computerized RTC details.

if anyone put stay at any land than that copy will be passed or informed to concerned dept ex taluk office or district office or not

if there is stay how govt dept will know there is stay on this land???

If he has communicate to Sub-registrar, then their knowledge. Moreover, if he has served you stay copy, its binding upon you.
