(Querist) 09 May 2013 This query is : Resolved
what are the procedure to register relinquishment deed ?one of the legl heir is abroad now and two are minors. physical presence of all legal heirs is needed for this ? how long it will take to complete the process ?
adv. rajeev ( rajoo ) (Expert) 09 May 2013
Yes his presence is necessary at the time of registration or PA holder of such person can also do.
Raj Kumar Makkad (Expert) 09 May 2013
Minor cannot relinquish their share. A permission is required from the court by their guardian under the provisions of Hindu Minority and Guardianship Act which shall take a long time. Third co-sharer living abroad can appoint his registered GPA in India through embassy of India and then the guardian in whose favour court provides permission and the GPA holder can do the desired action.

what is the law in case of christian family ? is there any other way to settle the case of minors ?

thanks for your valid advice..

Without leave of the court the relinquishment of share of minors would be voidable at the option of the minors.
