Good Morning Sir,
My sister has filed Maintenance petition under section 125 and interim maintenance against her husband for herself and her son after all the efforts of reconciliation and mutual consent divorce failed. My sisters husband refused to give her all the jewellery (Stridhan) and was only willing to give a minimal amount of couple of lakhs as final settlement. Her husband is a Bank employee as a Manager in Main branch of City. My sister holds a Savings bank Account in the same Bank but in different Branch not in the Branch where her husband is working. After this petition was filed in family court her husband has used his position as Manager in Main Branch and with the help of the Manager of the Branch where my sister is having an savings A/c.(the Account is single account in her name not a joint account with her husband) obtained the details of account statement of my sisters A/c. of last two years. Her husband applied through application to the Bank as husband to seek the statement of accounts of last two years and the Branch manager gave the details of all the affairs of her savings A/c.
Now My sister has filed a complaint in Branch and Local Head Office since last one and half months against Branch Manger and her husband on the grounds that Bank has divulged private and confidential data without her authorisation and her consent and requested the bank to taken action against both employees. But the Local Head office has not replied any thing in written instead a reply in letter form was given by the same Branch manager where my sister holds the savings account and who himself gave my statement of my accounts saying that we have given those details in good gesture as customer service as women do not visit bank too often and we give those details to husband in such cases. Also mentioning that the information was given to her husband and not to any unauthorised person. I must state that my sister has never visited the Bank with her husband as they are not at all on even on talking terms since last 4 years.
Now my query to you is :
(1) Can Bank divulge such private and confidential data to any unauthorised person who is not a joint account holder
(2) Bank is also not supportive as I have visited number of times to Local Head Office seeking their reply regarding any action to be taken against both the employees
(3) I have also filed complaint at their Main registered office of the Bank since last one and half month but I have not received any reply so far.
(4) Can any police complaint be filed against the branch manager and her husband
(5) Can any suit be filed against the Branch Manager and her Husband who took advantage of his position as employee and got the details with the help of Branch Manager in any court of law
(6) What legal remedies and under what law is available to my sister.
(7) Where can I file complaint against such employees of a bank who with malafide intention got the details of my sisters account. The Branch Manger has helped my sister husband by divulging the detials of her account even knowing that it is single account on my sisters name.
(8) I want to know is it a banking practice and does any law allow divulging such private and confidential data of a customer to an unauthorised person.

concentrate on your main case for maintenance .
this query ahs been repeated earlier wherein experts had opined that bank cnanot divulge confidential data of account holder to any aunauthorised perso n .
if you have filed complaints and no reply is received make a complaint to bank Ombudsman .
