Delay in full and final settlement from employer

Recive from a friend:-

i was doing job in a company as manager sales from 2 and half year. I left job on 31/03/2017 and till date company fail to give full and final settlement payment to me. What I do becoz it is already 60days gone company's HR didn't pick my phone and also don't meet me when I go to office.
And behave like a peon with me..

Send e-mails for settlement of the dues. Also send registered AD letter for your claim. Try to be polite in your language in both. Send 2-3 weekly reminders.

wait for a month.

If no response, discuss with local lawyer and send legal notice.

Instead of phone calls and visits now, prefer to transact in writing under proper acknowledgment, and narrate all previous transactions; by phone/emails/visits...........(mention dates/names/brief minutes).......to HR and with a copy to good offices of appointing authority,MD/CEO.



Escalate to good offices thereafter.

How many persons are employed in it?
What is your designation and nature of duties?



How many persons report to you?



Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state?
Since how many months you are working?
Do standing orders (model/certified) apply to establishment and your designation?


What is notice period as per appointment letter/offer letter and what was notice period tendered by you?



Was ever any stinker, memo, show cause notice on any misconduct issued to you?


Are you a member of employee’s/trade unions?

Has the establishment issued acknowledgment and acceptance of notice of resignation/final resignation, correct FnF statement, Form 16 of all years and last year as per correct FnF statement, salary slips of all months, PF a/c slips of all years, ESIC card, acknowledgment of handover of charge/assets, NOC/NDC etc etc?
