Delay in possession

My mother booked a flat with a builder in Gurgaon in their upcoming township three years back. The builder had taken 40 % of the total payment within a period of around one year. Balance 60% was to be paid on offer of possession. As per the builder buyer agreement which was signed after five months of booking, the possession was to be given within 36 months from the signing of agreement.
On our request the builder had issued a letter that the possession shall be given within 24 months of booking, but the fact is that even after three years the work has still not been completed and is going to take another 12 months or so. In addition to this there are certain patches within the township which belong to the farmers and are under dispute, the things have not been executed as planned.
All this uncertainty and delay has put us to great tension and losses. Our plans have gone haywire and
We want our money back with damages and interest. Please advise

Better you file complaint against builder before Consumer Forum and claim your money along with compensation towards mental and physical agony caused to you .

Send legal notice to the builder.
File consumer complaint, claim damages.

One / two of the builders in Gurgaon has been arrested, you can lodge complaint with the economic offenses wing if ingredients exist.
