Delhi high court fees for appointment of arbitrator

(Querist) 28 April 2012 This query is : Resolved
We had an arbitration clause through Arbitration Council of India but other party is delaying for the same.
Can we ask court to appoint the arbitrator for us?
Also is there any fees we have to pay along with our petition?
Will other party be noticed before?

You can move ahead as desired.

Charges for fee are different from state to state and even matter to matter in a same State. In my state charges are not below Rs. 5,000/- which is very meagre in UP as told by Prabhakar singh.

Arbitrator i like a court and he has to decide the matter in may seatings.

Appointment of arbitrator depends upon various factors and covenants of agreement deed.
Otherwise under the provisions of Section 11 of The Arbitration and Councilliation Act, 1996, High Court may appoint on application, and decide fees for the Arbitrator(s)

What are the terms in the agreement, accordingly you have to give notice to other side for appointment of arbitrator. If both of you fail to agree than only the matter can go to the court.
Shonee Kapoor (Expert) 01 May 2012
It all depends upon the terms of the agreement.
