I want divorce from my husband because he tortured me a lot.I have one 10 months old child. My all jeweleries are in my father in-law bank locker. so my query is that will i get all those jewellery that my mother gave me at the time of my marriage and also those that i got from my husband side too ??

Did you demand to return all your jewels from your in-laws?, if not do it soon, if demanded and not go any relief and you do not want to continue your married life or return to your matrimonial home, you can lodge a complaint through a women police or any jurisdictional police requesting them to recover the same from your husband's house or file a petition before a family court seeking a direction to husband to return the same;Ans for Q2: The jewels from your in-laws is not your property however how you can claim it as streedhana hence eligible to get it back. Try your luck

Not only getting back your jewelry, you have other rights also. First come to a conclusion whether you wish to severe the marital tie or not. Involve elders, family members, Women's rights activities, try to go for counselling - these are necessary as you have kid out of the marriage - if no positive results you can follow the advice of all above experts.

not only jewellery presented by your parents and their relatives. You have right to get all the jewellery gifted even by husband and his relatives.
retention of such articles by your FIL is criminal offence. More you delay more you are helping them.

I agree with Mr Kalaiseval and Mr Jaggarao. I would add that if you intend not to make any complaint then you must forget about the jewellery.
Generally FIL do not keep custody of jewellery and the type of FIL do so they are not to be convinced about returning till cowed down by existing powerful law.

I do agee with Sudhir. Section 406 IPC gets attracted in the given situation to get your jewellary back through police.
