File a suit for partition.
There is no negative 'points'.
It takes however longer time.

1. File a suit for partition, you and your father have a definite share in the property.

2. Court procedures in Civil Courts do take a lot of time, though your case looks like pretty clear, and there won't be major issues with it.

The cost is the fees of the lawyer which varies from a lawyer to lawyer.
