Reservation in govt. jobs.

Dear Expert, Kindly guide me and provide me information regarding how fortuitous circumstances affect the reservation in govt jobs. Due to fortuitous circumstances an obc category candidate joined on seats/vacancies reserved for obc candidates. Can that candidate be migrated/adjusted against unreserved replacement vacancies by selecting authorirty on the plea of his merit in selection exam. when the obc candidate as well as appointing authority had no grevience in this regard. The replacement vacancies was created because some of the provisionally selected candidates in unreserved category were found ineligible after verification of their testimonials. When the name of obc candidate was written against the reserved point in reservation roster, can that be deleted from that particular point and migrated to unreserved point in roster. A candidate belonging to OBC who has not availed any concession is entitled to be considered for unreserved vacancy if he falls in merit list above any general candidate. Such position can be from original selection or by revised select list if candidates provisionally selected in general category could not prove eligibility. In that case the vacated vacancy has to be given to the person higher in merit even if he is SC/ST/OBC and such candidate will be deemed to have not touched the reservation quota.
Remember there is no reservation for General category so a general category candidate cannot stake on additional vacancy (even if unreserved) while falling low in merit simply because the person above him is SC/ST/OBC.
You imagine a situation where a woman travelling in city bus be compelled to wait for ladies seat and compelled to vacate general seat even if she was earlier in queue then men.

I would like to add-
a) If a person belonging to OBC is selected under general pool and he chooses to migrate to OBC for a particular department, he can opt so.
b) His place in the general pool will be given to next best in general pool.
