I& my family is currently facing two 498a cases&one D/V case. one 498a case &the D/V case is running from the year 2004 & one 498a case from 2007.It will to you all learned people surprise that after lodging the cases my so called in-laws have never or any lawyer on behalf of them has ever appeared before the learned court,but the cases r there in the court& I have to attend them regularly & pay my lawyer regularlly.
my question is this,that is this is the system of India that despite non appearance of the complainant & no hearing still date for five years I have bear this harrassment for the rest of my life b,cause I well know they won't come b,fore the court as they know they r the people on the wrong side of the law
pls help me with U r's important advices

well dear really a pathetic state of affairs for u.
well u can be discharged/ acquitted for their non appearance....but since the actual documents are not in front of us here, so we can not give precise opinion here whether to move to High Court or to move some application before the trial court itself.
if possible make a search for lawyers from ur city on this portal and visit him/ her with complete documents.

Dear Chatterjee,
Being a state case, the Complainant does not appear on each and every date but will appear at appropriate time by summon of court for the purpose of evidence. From the narrated fact, the stage of your case is not clear. Therefore appropriate opinion in your case can not be given unless all facts are known.

My dear Friend
It is said law is blind. But some times I feel now the system is getting worse by handling of illiterate even though qualified. Shortcut is the method. Settlement of cass outside, long delay tactics, harrassement to witnesses,illegal arbitrory steps, first to convict, high cost and fees, advises which are not suited to facts and evidence etc. Fed up with this system. Rediculing the public. Still we have hope in it because other limps are already decayed.

1) they have been summoned by the court few times,but they have never appeared.
2)My wife is now an active member of a sleaze racket,which I do have some proofs.
3)They have brainwashed my daughter in such a way that she says she has forgotten her father.
In the said above situations can I get custody of my child
