Avoid anxiety and handle the case by remaining cool, gentle and amiable.
The court very well knows that deceased employee and legal heirs were not sitting idle…..and if the claim is genuine then can award interest and penalty as deemed fit..
Even if the court lacks jurisdiction the delay and afterthought by employer may not hamper your interest…
Your own very able senior LOCAL counsel of unshakable repute and integrity specializing in Labor/Service matters and well versed with local rules/codes and having successful track record ….. and worth his/her salt.. is to defend our interest by arguments in court…
You can check for such counsels at LOCAL Labor Court/Controlling Authority of Gratuity/CGIT/CAT/School-Educational Tribunal/Civil courts/HC/SC………….
Seasoned Employees’/Trade union leaders can also guide and help you.
