I have 2 consumer loans from BajajFinserve. Due to personal situation i have not been able to pay this month's EMIs on time. I am getting repeated calls from recovery agent even though i have tried to explain my situation and requested for a week's time to pay the EMIs. Today a recovery agent called me at 9PM and threatened me saying i have to pay immediately , if not he will come to my residence and he knows how to recover the money. Can i file a harassment complaint against this agent.

Record the call and file a police complaint.
However, you will have to discuss and sort out the issue with the money lender viz; BajajFinserve.

Sure, you can file a harassment complaint against the recovery agent, but also, as of reaction, you should expect some stringent action from the financial institution to recover its money. So, better settle the case direct by discussion with the bank.

Dhingra Saab, I understand that the financial institution will make efforts to recover the money, but the payment is delayed and I havent refused to pay. I have just now written an email to BajajFinserve Grievances cell and customer care with all details. Unfortunately their phone numbers dont work :(.

A debtor is always at the receiving end. Never think of taking any legal action against the company or its representative, while you are indebted. Only discussion on your personal visit to the company may help you to some extent.

Tell the recovery agent to come and collect money from your home, in the mean time help of good friends and relatives to be ready for taking action against the recovery agent for misbehaving with females of the family, give the agents good amount of beating and then call the police for getting them arrested for various crimes including criminal intimidation and sexual harassment of females of your family.
My advice may look bit odd but that's the language these goons understand, best way to handle the so called recovery agents.

Dear Sirs,
Suppose a person has one personal loan and one auto loan - the person is paying the auto loan EMI regularly but has not paid personal loan EMI for 2 months can the bank consider the auto loan also as NPA

If a real problem, where is the need of supposition? Your query, itself reveals as if you do not have any such real life problem, you posted.
Question arises, NPA or no NPA, a defaulter is always a defaulter. NPA is a term for the banks, not for the borrower, for the purpose of classification of internal accounts for the purpose of ease of accounting and maintenance of various statistics about its performance that the audit has to verify and the RBI to make a periodical review of that.
As a defaulter, you have nothing to do with NPA.

If you have auto loan, where was the question of s"SUPPOSE"?
Even otherwise, each account has separate entity. type of account is relevant, not the person having number of accounts.

Instead of trifling tit bits, you may better discuss the whole of the case in detail with some local lawyer or by sending to any of the experts of LCI. Casual queries, as per your own perception may not fetch advice on the real legal issues.
