Hi,
we are staying in pagdi system building in Ghatkopar, mumbai which was built in 1960, want to khow how much minimum square feet are we eligible for after redevelopment, my current room size is 100 sq.ft

For the redevelopment, you may apply to the RERA. There are chances to lose only some percentage of area

IF YOUR BUILDING IS NOT IN SLUM AREA, THE AREA OF FLAT A TENANT GETS ON REDEVELOPMENT DEPENDS ON THE REDEVELOPMENT AGREEMENT YOUR LAND LORD MAKES WITH THE DEVELOPER. HENCE ALL TENANTS SHOULD TAKE CARE THAT THE PROVISIONS OF THE RD AGREEMENT ARE FAIR TO THEM. YOU CAN INSIST FOR A MINIMUM AREA THAT IS PRESCRIBED BY THE GOVT UNDER THE SLUM REHABILITATION SCHME.(WHICH IS ABOUT 350 SQ FT CARPET ARREA.SUBJECT TO VERIFICATION)

Hello,
The builder can give carpet area depends upon the plot area and FSI applicable to the said plot. You can claim a minimum of 350 sq. ft. carpet area from the builder.

It is between the builder and occupier/ landlord, which has no legal formula.
It is advisable to consult and engage a local prudent lawyer for appreciation of fact/documents, professional guidance and necessary proceeding.
