Difference in date of birth for passport application

Hello, There is a 2 days difference in my birth certificate from my 10th marksheet' my real date of birth is 30/08/1989 which is on my birth certificate but my 10th marksheet has date of 28/08/1989 ..
My passort application is pending in rpo bhopal from last 16 months..they had sent me objection letter
Passport office is demanding fresh birth certificate which is not possible because birth certificate date never changed and markshhet change is also almost impossible procedure..
Pls guide me how do I get my passport ,
What is my right to get passport in this situation.

When you know there are differences in the date of birth, who asked you to submit both the documents to the Passport Office?

you have to move court to correct your xth std school leaving certificate based on your birth certificate

First try to get the correction in Xth certificate by contacting the institution which issued it.
You can approach court for direction, this may take some years in final decision.

U withdraw issuance of pass port at this stage considering not needed siince made mistake of submitting two different certificates. After some time apply for fresh PP submitting one Cert.

The suggestion by Jeevan PAtil is worst than the disease. It is not so easy. Whenever the new passport is being applied, then the applicant has to indicate whether he applied for it earlier and the result thereof. Even if he has withdrawn (though there is no provision for withdrawal of any application), he has to furnish the information. That will connect the facts. Further in case he does not reveal that he had applied for a passport earlier, then that itself will be an offence.

My birth certificate has the right date of birth , I don't think I will need 10th marksheet for any purpose ,10th marksheet is just for non ecr passport..
Can I tell to rpo bhopal that I will not need 10th marksheet for any purpose which has wrong date of birth...and my birth certificate is primary evidence of proof. Pls help

Now since the passport authorities are in the knowledge of two different dates of birth of yours, it will not be possible for you to make any excuses before them instead the only option before you is to get your date of birth declared by a court order, consult a local lawyer and proceed.

A good and Competent Advocate could complete the same with in a Maximum Period of 90 working days.Visit your court in Person and Choose the Right Advocate.Explain him every thing in detail with all Evidences/Documents Etc.Other things Fees Etc Confirm with him.

I have send a affidavit to passport office bhopal few months back in which I have told them according to my parents my real dob is 28/08/1989 my pan card also has this date..now rpo bhopal is demanding fresh birth certificate with correct date of birth which is impossible..
Now if I declared 30/08/1989 date by court order ..
It could become more complicated.
Officially my correct dob is 30/08/1989 but I have send them affidavit that my right date of birth is 28/08/1989.. my parents give 28/08/1989 date at the time of my school admission which never get changed ,I applied for birth certificate in the year 2010 they provide me birth certificate with date of 30/08/1989.now I passed 10th mp board in 2005 ..
Correction in 10th marksheet is almost impossible procedure after 9 years the school from which I passed 10th class is closed which should be open for marksheet correction..
It has become complicated ...
