Dear Lawyers,
Can anyone define exact difference between
the two " STATUS QUO in Possession and STAY ORDER" ?
How can we convince the Revenue Court, that status quo is not the Stay order and Revenue proceeding can be continued, Because there is no Stay Order on the Decree upon which appeal is filed by respondents and HC ordered Status Quo in Possession ?

If it is clear that status quo is in possession but revenue authorities has stopped their action.
If you have convinced them but they are denying. To create pressure on them you can ask under RTI that what is the reason that revenue proceeding is not being carried.

STAY ordering to stop what is going to happen whereas the STATUS-QUO means order to continue what is status of possession now. It depends upon facts of the case to establish the difference in practical shape.

"Stay order" means an order passed to stop the operation of a previous order either by same court or by it's superior court.
"Status quo"is a Latin term which means let a thing be in its' existing condition. In Law courts order it as substitute to a temporary
injunction where both the parties are supposed to maintain the status of disputed property in same condition as it is found on the suit date.

The same definition in different words have already been put to the author but he is not moving with the relevant facts of his case so that this definition may be made appropriate for him.

I do agree the reply on my query. the fact and circumstances is as below:
Civil court passed the decree and High Court has directed to maintain the status quo as on date on the possession. one more appeal is pending with the Commissioner revenue between same title and same matter.
Now I wanted to get the pending appeal dismissed in the commissioner court in the light of decree passed by Civil court in favor of respondents.

You can at any time get your appeal dismissed as withdrawn in the changed circumstances.
