This query is : Resolved
We have an educational trust owning 6.20 acres of land with 23000 sq ft building in which a course is being run at present.
We intend to retain 2.20 acres and sell the remaining 4.00 acres to one of the trustees.Later we plan to sell the remaining land and the building to any third party who would be interested in the purchase.
We would like to know the procedure in selling off this trust property.

without SEEING THE CASE PAPERS IT IS DIFFICULT TO ADVISE.
If it is public trust then permission of court is necessary to sell trust property.

Even if it is a private trust, you need to pass a resolution to sell the property.
In case of a property of a Public Trust, resolution has to be made and thereafter, Competent Court has to be approached to sell the property

It is education trust with 6.20 acres of land. Must be already having a lawyer. Consult him keeping the above points in mind.

permission of charity commissioner [Public trust] a must.
Property belongs to charity commissioner.trust.
Only resolution is useless. .
the conveyance of the Suit Property could not be executed without the technical formality of obtaining the permission from the Charity Commission, under Section 36 of the Bombay Public Trusts Act 1950.

I agree, better approach a local lawyer, discuss with him at length and proceed as per his advise.
