Disrtribution of ancestral property

Sir/Madam,
My father married his elder brother's wife after his demise at early age leaving a son, but didnot adopted him legally. Can he claim share in my father's property legally if my father didnot write any will. And if my father write his will mentioning his name in the share , can i approach court against it.

academic query . if your father has left a will he cna bequeath his property to whom soever he desires . if he did not leave a will property would be inherited by his legal heirs ie wife and son

wife would be one legal heir. Other legal heir also would have equal share. The step son would not have any share legally.
