Distribution of property !

Dear Sir
I want a clarification as per law. my query is i have 2 brothers in which 1 brother is step brother now my step brother is wants 50 % share in property and rest 50 % for me & my younger brother my father is still alive and property belongs to ancestry not earned by my father. please suggest me that how it will be divided as per low.

Sir,

Step brother is not entitled to share in the property . You and your father will get the equal share along with other class I heirs.

Just because your father did not earn the property does not mean it is 'Ancestral'.

You have to indicate who first purchased the property, in which year, and how (from one person to another person indicating the years) that property came to your father's hands.

Only thereafter one can give appropriate reply to your query.

The question of property being ancestral or not need to be decided first for proper advise.

Consult local lawyer and show him all the documents.

as an ancestral property all of you wil get equal shares only. nothing as like your step brother's idea.

Mr. Rajendra K. Goyal is absolutely wrong when he says that "The question of property being ancestral or not need to be decided first for proper advise."

I am afraid that Mr. Goyal has failed to appreciate that -

(i) if the property is truly ancestral, then the querist can definitely seek partition.

(ii) If the property is not ancestral, then no one (i.e. sons whether real or step son) can make any claim, because it is stated that the father is alive.

Therefore, I once again reiterate that Mr. Rajendra K. Goyal is absolutely wrong in his answer/comment/view.
