Divorce

Dear sir,
we married date on 23.05.2011,and our life is going very well but due to some misunderstanding from my wife side. she demanded divorce from me,and they are continuously pressurize to me, so i was sign divorce agreement printed on rs.50 stamp paper with notarize. it is valid for divorce? and i am continuously calling my wife for come to home but she is not ready for that. what should i do? by caste we are Gujarati leva patel. i agree to solve her problem.

Dear Mr.Patel,

The agreement that you've signed is not a divorce in the eyes of law. You still have to go to the court to get divorce. Your wife's family seems to be bent upon on the divorce. If you don't give in to their demands - they might try to file false complaints against you - watch out for false 498A/406.

Consult a good lawyer - do the basic homework for your protection.

not valid. if any advocate involved in it will be punished as per HC ruling.
report to police, divorce is not binding.

This is not a valid divorce. You can complaint to the police as suggested by Mr.Shroff and the advocate and the norary too will be punished in this case.

If the wife is not ready to return, then it is advisable to keep quite for some time without approachig her. Just wait and watch.

But, if she is not at all interested in living with you, then it is better to agree for the divorce and file a petition for divorce by mutual consent.

Our life is short. Why to waste it running behind someone who does not want our company??

Divorce should be ratified and pronounced by court of law by following a due legal process, not by mere entering in to a mutual agreement on a Rs.50 stamp paper.
