Divorce

Querist : Anonymous (Querist) 27 October 2010 This query is : Resolved
Hi,
I have applied for divorce under cruelty & mental torture (& affairs with other ladies)..
My husband has appeared for the 1st hearing & did not appear for subsequent 3 hearings (meant for counselling)
Can I request for exparte divorce? Can I do it individually or only my advocate can do it? What are the procedures for getting exparte divorce?

what is the stage?

It is in counselling stage.. Judge has ordered for counselling, but my husband did not turn up at all..Until now, I had attended 4 hearings.. He had attended 1st hearing... From next hearing onwards, (when judge has ordered for counselling) he did not appear in the court..
He is residing in out of station... Will this make any difference?

REQUEST THE COUNSELLING AUTHORITY TO SENT BACK THE CASE FILE TO THE CONCERNED COURT FOR FURTHER PROCEEDINGS.

f the husband repeatedly fails to appear then apply to the court to fix the case for ex parte hearing.
