Divorce

I have filed a divorce suit under Section 13 of HMA under mental cruelty and desertion against my wife after 33 years of marriage. I have sufficiently good grounds of mental cruelty and desertion.
She draws a salary of 75K per month.My son is 30years old and working well and supporting himself in Mumbai.I stay with my very old bedridden 95 years old mother who supports her instead of me beccause she is not prudent,she is uneducated,she has no knowlege of legal succession process,she has a destructive behaviour of disowning her own daughter 15 years ago etc etc. Dear experts how can a old mother affect this divorce suit though it is a husband-wife issue.The property is to come on my name after her life time. Mother has no transferable rights.

1) you have been married 33 years

2) your mother is 95 years old bedridden and yet she supports your wife whom you want to divorce .

3) your son is around 40 years old .

you ahve stated that she has deserted you and you want a diovrce on account of cruelty .

from these facts stated by you it would appear that it would be better you reconcile your differnces as even your mother is supporting your wife and you have been married for . 33 years.

if your wife does not agree to diovrce it will take you atleast a couple of years in mumbai to get divorce .

What is this nonsense at the fag end of life to file petition for divorce?


It do not fit you to plead cruelty at this stage of life. What were you doing since last 33 years?

I suggest you to withdraw your petition and serve your bedridden mother and take her blessings.

You can decide your properties as per your own wisdom and leave the wisdom of your mother to herself.

Even after divorce, she can will her properties to your son/ wife.

You have stated that you have a good ground for mental cruelty and desertion. What are those? You have stated the grounds which are against you. Be ready to face 498A IPC.
