Divorce

Request your inputs n the questions mentioned below. If my husband does not turn up for the second motion of MCD and I file the contested divorce:

1- Can we use the declaration signed by him in the women's cell that we would proceed filling of MCD due to irreconcilable differences and then backing up on the second motion of MCD as a reason for divorce due to cruelty.

2- Do the papers/ agreement signed under the investigation of complaint filed in women cell have any relevance in the court of law.

3- If both of us have signed Oct 2012 as the separation date in the women's cell papers and MCD petition. Would that be considered sufficient to prove the separation date in future or we have to legally file separation?

4- Can we get divorce on basis of separation? If yes, after how many years incase husband not ready for MCD.
