HI..one of my friend filed divorce case as she is not willing to live with the guy. However guy is not ready to give the divorce. After many hearings now guy wants to go for mutual divorce. we suspect some conspiracy behind mutual and we are thinking that they want to delay the process by changing from regular to mutual and vice versa.
please suggest what are the actions or precautions to be taken while changing the divorce case from regular to mutual? is there any chances of being cheated with this kind of approach? if filed for mutual what is the expected time to get divorce?

If you have already filed a divorce petition, then why to go for mutual consent divorce. Let him proceed for divorce before the same court.

We came to know that judgement is quick incase of mutual agreement.my friend has personal problem and she also require quick resolution.what are the complexities for going mutual now? Any chances of manipulation from other side?

Let both lawyers prepare and submit Mutual Consent Divorce petition, if arrived, it would be better for all.

Hi all. Thanks for your replies. Please let me know what will happen if guy withdraws mutual case in future again just to delay case?. Also how to proceed further given the above circumstances? Can we keep both the mutual and existing cases simulateanously?

If any party to the MCD does not turn up for second motion, case can be kept pending for 18 months or can be dismissed.
Contested divorce Case can be filed again.

Every Author/Querist Who Post Here will be Certainly having their Advocate But Still they Post Here for More Legal clarifiation/and to Clear Their Doubts.Better Not to Insult them and Who doesn't have an Answer Could Just Ignore Them Than Posting a Grand Advise of "Consult A Local Advocate".Mr.Bharat had even Posted an Advise to Advocates It Self that there will be No BCI Exam this year and Only to Practice in Other States the Exam to be Attended.Great.

I had already Suggested the Mutual Consent Divorce would be the Best Option which could be Completed in 6 month Time.First Approach the Other Side with some Good and Sound People and get the Consent from other side and Proceed for Other Side.If the Divorce Case is already Pending you both Need Not Attend the Court till MCD gets Completed and then it could be Withdrawn.If No Case Pending First Make your Efforts for MCD with the help of Good People.
