Dear Experts

I have inquiry regarding divorce as following.

What is the definition of divorce?
Can wife stay/reside in same house of his husband after divorce?

Sir, This a case of my elder brother. He had filed divorce case. Case goes on 3 years. Case was running well in our favor, but in last our lawyer changed and cheated us and tried to compel my brother to compromise. My brother refused till last not to compromise saying that he can't live with her because she is very cruel and make very cheep allegation on him. This is the real fact which I known as a brother. They succeed and compromised in the court and reunited his wife. After 3-4 months of re-unit she started to show her colors. She started quarrel with him and put poor and cheep allegation on him. Last month she quarreled with him again some issue and hit her head with wall and shouting that he beaten her and call the police. It seems that she came back to take revenge. Her parents are also of same nature.

And some one told my brother that you can't get her out. If you file for divorce again she can remain in your house after divorce. Just she will be separated from you. That's why I put this query.

1. Fresh divorce suit in subsequent cause of action can be filed.
2. If the particular house doe snot belong to you brother then she can not legally stay therein.
3.It is better to end this marriage as this does not seem to work. The sooner is better.

file for divorce again . it makes no sense in continuing relationship wherein wife is not willing to compromise . wife has right under DV act to stay in matrimonial home

Forget whatever has happened in previous litigation. File fresh divorce petition which is likely to be succeeded on the basis of cruelty.
