Dear Experts
One of my client was married on in the month of march-2018, April -2018 deserted from the husband due to misunderstanding, now wife want to file divorce petition under this circumstance with petition file to divorce.

Please read Section 13 of the Hindu Marriage Act if she is a Hindu (or otherwise her relevant law) and see on what all grounds a party can file a divorce petition.
Divorce can be obtained only on those listed grounds.

If this is Hindu marriage, move application under section 14 of the Hindu Marriage Act,1955 for the Family Court to allow the divorce petition under section 13 HMA entertained within one year of marriage on the ground of exceptional circumstances of the case. that is detrimental for the parties.
