Divorce proceedings

Guest (Querist) 04 October 2011 This query is : Resolved
Dear Experts

Is there any way in our rotten Legal system to expedite the dates for hearings?

For a contested divorce, if a Husband goes through years of struggle to get a divorce from his cruel wife, then hardly he has any energy and inclination to settle again....

Why Only in our country, Divorce process takes so long?????

few courts

backlog of cases

large population compared to number of courts .

always advisable to take divorce by mutual consent

How Mutual consent,, when my wife is not interested to give the divorce and wants to pursue the divorce proceedings for 15-20 years unless I compromise with her by becoming a Ghar damad and stay at her house,,, what should I do?

Kindly advise since I am in this mess, my rich wife wants me to stay at her house Or she is ready to fight for 15-20 years in court...... She has no financial problems and no intention to resettle as well.... just being revengeful with me and making full use of women powers.

There are so may causes for delay:1)lack of available hours in court,2) no.of cases,3)back dated process of trial,4)defend by the opposite party,5)lack of our intention,6)negligence by concerned authority etc.You should file a Writ Petition in High Court under article 227 of the Constitution of India for quick disposal of the suit.

Causes of speed less justice are numerous ,few already counted, the problem is that both governance and public does have a feeling but no will to improve.
OF all causes the greatest evil as cause is one side of any case is always with intention to delay the justice ,your own case it self is a good illustration to drive home my point, then all other causes of delay becomes a machinery to aid it,and rights pend in frustration.

You can apply for speedy trial under 21B(2) showing exceptional hardship.

Divorce proceedings are supposed to be completed in 6 months. Move HC if abnormally delayed.
